Terms of Service

Welcome to Samim ("the App", "we", "us", or "our"). By downloading, installing, or using Samim, you agree to be bound by these Terms of Service ("Terms"). Please read them carefully. If you do not agree with any part of these Terms, you must not use the App.

1. Eligibility

You must be at least 13 years of age to use Samim. If you are between 13 and 18 years old, you confirm that your parent or legal guardian has reviewed and agreed to these Terms on your behalf. We do not knowingly collect personal information from children under the age of 13. If we become aware that a user is under 13, we will promptly delete their account and associated data.

2. Account Registration

Samim uses your mobile phone number to create and verify your account. By registering, you agree to:

• Provide an accurate and valid phone number that belongs to you.
• Keep your account information up to date.
• Not share your account access with any other person.
• Notify us immediately if you believe your account has been compromised.

You are responsible for all activity that occurs under your account.

3. Acceptable Use

By using Samim, you agree not to:

• Use the App for any unlawful purpose or in violation of any local, national, or international law or regulation.
• Send, share, or post content that is hateful, threatening, harassing, defamatory, obscene, or pornographic.
• Impersonate any person or entity, or falsely claim an affiliation with any person or entity.
• Spam or send unsolicited messages to other users.
• Attempt to gain unauthorized access to any part of the App, its servers, or its databases.
• Use automated tools, bots, or scripts to interact with the App.
• Collect or harvest personal information of other users without their consent.
• Upload or transmit viruses, malware, or any other malicious code.
• Engage in any conduct that restricts or inhibits another user's enjoyment of the App.

4. User Content

Samim allows you to send messages, share photos, videos, documents, and post to the community feed ("User Content"). You retain ownership of any content you create. By posting User Content, you grant Samim a limited, non-exclusive, worldwide, royalty-free license to store, display, and transmit your content solely for the purpose of operating and providing the App's services.

You are solely responsible for the content you share. We do not endorse, verify, or take responsibility for any User Content posted by users.

We reserve the right to remove any User Content that violates these Terms or that we deem harmful to the community, at our sole discretion and without notice.

5. Privacy

Your privacy is important to us. Our Privacy Policy describes how we collect, use, and protect your personal information. By using the App, you agree to our Privacy Policy, which is incorporated into these Terms by reference.

6. Intellectual Property

All rights, title, and interest in and to the App — including its design, graphics, code, trademarks, and content created by Samim — are and remain the exclusive property of Samim and its licensors. You may not copy, modify, distribute, sell, or lease any part of the App or its content without our prior written consent.

7. Third-Party Services

Samim integrates with third-party services to deliver its features, including but not limited to:

• Supabase – database and authentication
• Agora – voice call technology
• Expo / Apple Push Notification Service (APNs) – push notifications
• Twilio – SMS verification

Your use of third-party services is governed by their respective terms and privacy policies. We are not responsible for the practices of these third parties.

8. Calls and Communications

Samim provides voice calling features. All calls are routed through Agora's infrastructure. We do not record calls. Standard data charges from your mobile carrier may apply when using the App.

9. Disclaimers

Samim is provided on an "as is" and "as available" basis without any warranties of any kind, express or implied. We do not warrant that:

• The App will be uninterrupted, error-free, or secure at all times.
• Any errors or defects will be corrected.
• The App or the servers that make it available are free of viruses or other harmful components.

To the fullest extent permitted by law, Samim disclaims all implied warranties, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Samim and its owners, employees, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or related to these Terms or the App shall not exceed the amount you paid us in the twelve (12) months preceding the claim (or $10 USD if you have not made any payments).

11. Account Termination

You may delete your account at any time from within the App's Profile settings. Upon deletion, your personal data will be removed from our active systems in accordance with our Privacy Policy.

We reserve the right to suspend or terminate your account at any time, without notice, if we determine that you have violated these Terms or engaged in conduct that is harmful to the App, other users, or third parties.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Last Updated" date at the top of this page. Continued use of the App after changes become effective constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the United States, without regard to its conflict of law principles. Any disputes arising under these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
